Emkido™ / Lorsam
Last updated: 25 September 2026, 00:39 CEST
OVERVIEW
Welcome to Emkido! This online store is operated by Samer Radwan, a sole proprietor trading as Lorsam under the Emkido™ brand. In these Terms and Conditions, “we”, “us” and “our” refer to Samer Radwan as the seller.
These Terms and Conditions apply to purchases of digital products from our store. Please read them before placing an order. Information about how we process personal data is provided separately in our Privacy Policy.
Our online store is powered by Shopify. Your contract for products purchased from this store is with us, not with Shopify.
1. SELLER AND SCOPE
1.1 Your contracting party is:
Samer Radwan
Sole proprietor (Lorsam)
Brand name: Emkido™
Sebastianstr. 34
66773 Schwalbach OT Elm
Germany

1.2 These terms apply to contracts for digital products purchased through the Emkido online store, including digital learning materials and printable files. If an individually created digital product is offered, the details agreed in its specific offer also apply.
1.3 Mandatory consumer rights are not limited by these terms. Individually agreed terms take precedence where applicable.
2. PRODUCTS AND FORMATION OF THE CONTRACT
2.1 The relevant product description sets out the content, file format, price and, where applicable, technical requirements of the digital product. Displaying a product in the online store is not, by itself, our binding offer to sell it.
2.2 Before submitting your order, you can review and correct your entries. By using the final order button, you submit a binding order for the products shown in the checkout. The total price and available payment methods are displayed before you submit the order.
2.3 We send you an email acknowledging receipt of your order. An automatically generated acknowledgement alone does not constitute acceptance unless it expressly states that we accept your order. A contract is formed when we expressly accept the order or make the ordered digital product available.
2.4 Submitting an enquiry about an individually created learning book does not itself place an order for the finished product. The specific offer and its acceptance determine the terms for that product.
3. INDIVIDUALLY CREATED DIGITAL PRODUCTS
3.1 If we offer an individually created digital product, its characteristics, price, creation process and delivery time are specified in the particular offer. We use the information you provide for the agreed creation process.
3.2 Please check the information you provide for personalisation. Whether changes are possible after approval, and to what extent, depends on the specific agreement.
3.3 Statutory withdrawal rules applicable to the particular contract also apply to individually created digital products. Personalisation alone does not remove all consumer rights.
4. PRICES AND PAYMENT
4.1 Prices shown in checkout are total prices in euros. The total shown before you submit your order is the relevant price for that order.
4.2 Available payment methods are shown in checkout. Payment is processed using the method you select.
4.3 According to our legal notice (Impressum), we apply the small-business VAT scheme under section 19(1) of the German VAT Act (UStG). VAT is therefore not charged or shown separately.
5. DELIVERY OF DIGITAL PRODUCTS
5.1 Products covered by these terms are delivered digitally; no physical item is shipped for these products.
5.2 For immediately available digital products, you will receive an email containing your download link no later than 24 hours after successful payment. If you do not receive the email within 30 minutes, please check your spam or junk folder and contact support@emkido.com if it has not arrived. Access may also be available through the access method shown with your order. The timing for individually created products is stated in section 5.3.
5.3 Individually created products are delivered at the time agreed in the relevant offer. An enquiry or order for a product to be created individually does not mean that a finished file is immediately available.
5.4 The product description provides information about file format, compatibility and other technical requirements. If you have difficulty accessing or opening a file, contact support@emkido.com.
5.5 Statutory duties concerning delivery and any updates to digital products remain unaffected.
6. INTELLECTUAL PROPERTY RIGHTS AND LICENCE
6.1 Intellectual property warning: Unauthorised reuse, republication, distribution or sale of Emkido™ books, digital files or their content may result in legal action. These rights are held by Samer Radwan, trading as Lorsam under the Emkido™ brand. Uses permitted by applicable law remain unaffected.
6.2 Upon purchase, you do not acquire ownership of the content or its intellectual property rights. You receive a personal, non-transferable, non-exclusive licence to download and store the file on your own devices and to print it for your own private use.
6.3 Subject to this limited licence, all copyright and rights of reproduction, distribution, publication, resale, sublicensing and adaptation remain exclusively with Samer Radwan, trading as Lorsam under the Emkido™ brand. All rights not expressly granted are reserved. Without our prior written permission, you may not share, redistribute, republish, sell, sublicense, or otherwise reuse the file or its content beyond the private use permitted in section 6.2.
6.4 Digital protection: We use protective measures (including, but not limited to, the Emkido™ watermark) designed to deter unauthorised copying, redistribution, resale, or other unauthorised use of our digital files. These measures do not grant permission to share, resell, or use a file commercially.
7. RIGHTS IF A PRODUCT IS DEFECTIVE
Statutory consumer rights relating to defects in digital products apply. These terms do not exclude those rights or limit them to receiving a replacement file. If there is a problem with a file, access or the agreed characteristics of a product, please contact support@emkido.com so we can review it.
8. RIGHT OF WITHDRAWAL FOR DIGITAL CONTENT
8.1 We provide separate information about the statutory right of withdrawal and how to exercise it. These terms do not replace the withdrawal instructions.
8.2 For digital content not supplied on a physical medium, the right of withdrawal may end early if all applicable statutory conditions are met. These include the consumer's express consent to performance beginning before the withdrawal period ends, the consumer's acknowledgement that the right of withdrawal is lost when performance begins, and the legally required confirmation on a durable medium.
8.3 Where required for the order, consent and acknowledgement are requested separately during the purchase process. A statement in these terms alone does not replace those declarations.
8.4 The right of withdrawal does not end merely because a digital product was ordered or paid for. Whether it has ended early depends on the statutory conditions in the individual case.
9. LIABILITY
9.1 We are liable without limitation for intent and gross negligence, and for injury to life, body or health.
9.2 In cases of slightly negligent breach of a material contractual obligation, liability is governed by applicable law and limited to foreseeable damage typical of the contract where such a limitation is legally permitted. Material obligations are those whose fulfilment makes proper performance of the contract possible and on which you can normally rely.
9.3 Mandatory statutory liability provisions and your statutory rights relating to defects remain unaffected.
10. PRIVACY
Information about the processing of personal data is provided in our Privacy Policy. These terms do not replace that policy or any consent required for cookies or similar technologies.
11. CONSUMER DISPUTE RESOLUTION
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
12. GOVERNING LAW AND FINAL PROVISIONS
12.1 German law applies. Mandatory consumer protection rules of the country in which a consumer habitually resides remain unaffected where they take precedence under applicable law.
12.2 If a provision of these terms is ineffective, the statutory provisions apply in its place. The remaining provisions remain in effect.
